Many persons seeking the services of a criminal defense lawyer, usually under highly pressurized circumstances, review yellow page, or internet ads, for legal assistance. A quick review of these ads, however, indicates that many defense lawyers loudly proclaim their role as "Former Prosecutors", leaving the unstated suggestion that former prosecutors retain special connections in the Bronx DA's office, or know of some secret method, or unknown process, for obtaining victory for their potential client.

The fact of the matter, however, is that many former prosecutors simply lack experience as trained criminal defense lawyers. In fact, the vast majority of prosecutors leaving the Bronx District Attorney's office have only tried a handful of criminal cases, and have never represented a defendant at a hearing, trial, arraignment, or in any other legal capacity. Furthermore, many former Bronx prosecutors retain an uncomfortably chummy relationship with their former collegues. It is this fact that seriously impairs the ability of the former prosecutor turned defense lawyer from aggressively representing their client. A former prosecutor turned defense lawyerwill not charge their former collegues with prosecutorial misconduct. He will not charge his former collegues in the DA's office with a cover-up. He will not charge his former friends in the DA's office withnegligence, incompetence, or ethical violations. In fact, many former Bronx prosecutors are actually treated harsher by members of the Bronx District Attorney's office out of fear of being accused of favoritism.

Finally, many former Bronx prosecutors seek to maintain an extemely cordial relationship with their former friends, supervisors, and collegues in the DA's office just in casea return to the office as an employee may be necessary.

In short, persons seeking the services of a criminal lawyer in the Bronx would be wise to hire an attorney with no prior connection to the Bronx District Attorney's office.*
